Bail is the amount of money required by
the court to release a defendant from custody and to guarantee
their appearance in court. Bail is set by the Judge based on
the severity of the offence, past criminal history, and the
geographical economic index.
In some cases either cash
or a Bail Bond (a financial guarantee) must be given to the
court for security. Once a bail bond is posted the Premium or
fee is earned, theBail Bond Agency then becomes responsible for the defendant’s
appearance in court.
When a defendant fails to appear each time
required the court will "forfeit" the bail and demand payment
from the bail bond agency. The agency will locate and arrest the defendant and
place him in custody of the court and demand payment from the
"Indemnitor(s) to recover their
costs.
As the Indemnitor it is import to understand
that there is
absolutely NO RISK in pledging any amount of
collateral to a
bail agency as long as you are 100 percent certain the
defendant will not flee and appear in Court each time as
required.
The Eighth Amendment to the U.S.
Constitution requires th at bail not be excessive.
This means that bail should not be used to
raise money for the government or to punish a person for being
suspected of committing a crime. The purpose of bail is to
give an arrested person his/her freedom until he/she is
convicted of a crime, and the amount of bail must be no more
than is reasonably necessary to keep her from fleeing before a
case is over. Bail is set to assure the attendance of the defendant, when
his or her appearance is required in court, whether before or
after conviction. In most cases, bail money will be returned
at the end of the
trial, if all court appearances are made, no matter whether the person is found
guilty of the crime accused. Legislatures also set out certain crimes
to be "unbailable," such as capital
crimes or in some cases premedit
ated
murder
